Terms of Service

These Terms of Service ("Terms") govern your use of the Linx mobile application (the "App"). By using the App, you agree to these Terms.

Operator Information

Acceptance of Terms

By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

Eligibility

You must be at least 13 years old to use Linx. By using the App, you represent that you meet this age requirement.

User Accounts

1. Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You are responsible for all activity under your account
• One person may not maintain more than one account

2. Account Security

• Keep your password confidential
• Notify us immediately of unauthorized access
• We are not liable for losses from unauthorized use

User Content

1. Content You Post

• You retain ownership of content you post (rounds, reviews, photos, notes)
• You grant Linx a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the App
• You grant us the right to use your content for marketing and promotional purposes (with attribution)

2. Content Standards

You agree NOT to post content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
• Infringes on intellectual property rights
• Contains spam or unsolicited advertising
• Contains false or misleading information (fake reviews, fake courses)
• Contains viruses, malware, or harmful code
• Violates any person's privacy rights
• Is sexually explicit or inappropriate
• Promotes violence or discrimination

3. Content Removal

• We reserve the right to remove content that violates these Terms
• We are not obligated to monitor all user content
• We may, but are not required to, review content before it appears

Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Impersonate any person or entity
• Interfere with or disrupt the App or servers
• Attempt to gain unauthorized access to the App
• Use automated systems (bots, scrapers) without permission
• Harass, abuse, or harm other users
• Collect user information without consent
• Create fake accounts or manipulate ratings
• Reverse engineer or copy the App

Golf Activities and Assumption of Risk

• Linx is a social platform for sharing golf experiences
• We do NOT provide golf instruction, course recommendations, or safety advice
• Course ratings and reviews are subjective user opinions, not professional assessments
• We are not responsible for the accuracy of user-generated content
• We are not liable for injuries, damages, or losses incurred while golfing

Intellectual Property

1. Our Rights

• The App, including design, code, logos, and trademarks, is owned by Linx Golf LLC
• "Linx" and the Linx logo are our trademarks
• You may not use our intellectual property without permission

2. Copyright Infringement

If you believe content infringes your copyright, contact us at hello@linxgolf.app. We will respond to valid DMCA takedown notices.

Termination

1. By You

• You may delete your account at any time through the App settings
• Deletion is permanent and cannot be undone

2. By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Harm other users or the App
• Are inactive for an extended period
• At our sole discretion for any reason

3. Effect of Termination

• Your access to the App will be revoked
• Your content may be deleted
• Some provisions of these Terms survive termination (liability, disputes, etc.)

Payments and Subscriptions

1. Current Pricing

• Linx is currently free to use
• We reserve the right to introduce paid features or subscriptions in the future

2. Future Paid Features

• We will provide notice before charging for any features
• Subscription pricing and terms will be disclosed before purchase
• Payments processed through Apple App Store or Google Play Store
• Refunds subject to Apple/Google policies

3. Changes to Pricing

• We may change prices at any time
• Current subscribers will be notified 30 days in advance of price changes

Disclaimers

We disclaim all warranties, including:

• Warranties of merchantability or fitness for a particular purpose
• That the App will be uninterrupted, secure, or error-free
• That course information, user content, or ratings are accurate
• That defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for:

• Indirect, incidental, special, or consequential damages
• Lost profits, data, or business opportunities
• Damages resulting from your use or inability to use the App
• Damages from user content or third-party content
• Damages from unauthorized access to your account
• Injuries or damages incurred while golfing

Our total liability is limited to $100 or the amount you paid us in the past 12 months, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Linx Golf LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person
• Content you post on the App

Dispute Resolution

1. Governing Law

• These Terms are governed by the laws of the State of Connecticut
• Disputes will be resolved in courts located in the State of Connecticut

2. Informal Resolution

Before filing a claim, contact us at hello@linxgolf.app. We will attempt to resolve disputes informally.

3. Arbitration (Optional)

• You may elect to resolve disputes through binding arbitration
• Arbitration conducted in Connecticut under AAA rules
• Each party pays own costs

Changes to Terms

We may modify these Terms at any time. We will notify you by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending a notification for material changes

Your continued use after changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Linx.

• We may reset data during beta testing

• You grant us the right to use feedback without compensation

• You agree to comply with all export laws
• You will not use the App in embargoed countries

By using Linx, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
